OT: I Was in a pretty serious car accident

->> On Wednesday I was traveling south on hwy 65, the car in front of me stopped to turn, I stopped but the car behind me hit my car at 50 mph; totally my car.
I was knocked unconscious and the next thing I knew I was being pulled out of my car by the ambulance crew. I was taken to the hospital for tests and it was discovered that I had a concussion and bleeding on the brain.
They insist that I stay overnight for observation, and the next morning I was released.
Here is my question: Does anyone know how much money I should expect for pain and suffering? That seems fairly gray and uncertain.
They other driver admitted guilt, he was cited by Ohio Highway Patrol. But I am very curious how much I should expect from an accident like this. I had a concussion, bleeding on the brain, and pretty serious pain around the chest area.
I don't want to meet with the other guy's insurance company completely ignorant of what I should have coming to me.
Does anyone have an idea what to expect? |

->> Patrick,
Perhaps you are right, I was hoping someone had a magic bullet formula that took into consideration all the factors involving the accident and that could spit out a ballpark figure of what to expect. |

->> Mark,
Yea, I guess the pain and suffering is a pretty uncertain figure.
The value of the car is pretty locked in. My medical bills will be paid for, but how do insurance companies calculate pain and suffering?
I was hoping someone on sportsshooter had a similar experience and could shed some light on this. |

->> Not posting Legal advice.. But I was rear ended at 45. Suffered severe whiplash that I had to undergo PT for 4 months to stop the stiffening of my neck, lost work, basically lost my wedding business due to it. Because I have State Farm and the guy that hit me had state farm, I got roughly a settlement for $25k + medical (which the attorneys take 1/3 of ALL including medical)
Had it been a different insurance company, or if I really wanted to pursue my own insurance company, I'm sure I could had.. But.. That's how mine went.
With that said, talk to people you know.. GET A GOOD ATTORNEY IMMEDIATELY!!!! |

->> John,
I am not a attorney. Do what others have suggested and get a very good lawyer who is experienced in dealing with insurance companies and accidents and quit posting about it on here.
My reason for posting is your injury. I suffered a fracture skull in either late November or early December and was air flighted 100 miles because they were worried it might bleed.
Make sure that your doctors are cool with your health. What I've learned is that brain injuries are serious business - even "minor" ones - "there are", as someone who has worked with brain trauma told me, really "no such thing."
One doctor told me I have a 20% chance of having a seizure over the next 12 months, and I'm in good shape.
My message is clear: Make sure your injury is under control and poses no risk to you long term. If this is mishandled, legal liability will be the least of your concerns if your health goes south. |

FIRST: LISTEN to Patrick Fallon and STOP POSTING ON HERE.
SECOND: Your member page shows the last 5 threads you've contributed to. Trust me when I tell you that you DO NOT want opposing council to find this thread when they Google you (and they WILL Google you) so post something helpful in 5 more threads to bump this off your member page and then never come to this thread again. |

Asking for legal advice on SportShooter is like asking for me to perform brain surgery...the outcome is nothing short of bad. |

->> No I was not asking legal advice, I was asking people's personal experience with similar circumstances.
In hindsight, I realize it was a mistake, but I am heavily sedated due to my injuries, which include a concussion and a cracked rib.
Chuck, it would be nice if you got off you stump for once and stopped talking down to people.
When sportsshooters.com members don't renew because of the poison that is spewed on the message board, they are referring to jerks like you.
If you don't like a question I ask, please shut up. I don't to hear your ridiculous complaints.

Where do you get off policing what is asked on this forum. Why do yo concern yourself?
I have seen your venomous comments time and time again.
There are countless times I have seen questions that I thought were inappropriate or silly, but for some reason you feel it is your obligation to belittle someone publicly when they ask a question that you feel does not fit into YOUR perception of appropriate.
Do everyone a favor, and keep your toxic, snide remarks to yourself. |

DRUM ROLL...
Lack of impulse control.
JOHN....STOP POSTING... You are going to say something you will regret and it might be because you have a concussion.
STOP POSTING and maybe make a request that this was an ill-advised thread based on your medical condition and have it removed. And if they don't remove it...
STOP POSTING...
Trust me on this...my wife had a concussion last year, she is still suffering the effects, but her boss pissed her off, and thanks to that lack of impulse control, she quit her job. She still hasn't found actual employment. The upside is she is a lawyer and can get money through private practice, but hopefully you get the point.
STOP POSTING... |

Unfortunately, these posts cannot be deleted.
So, call an attorney, and stop posting. |

->> John, the reason you shouldn't be posting about this has nothing to do with it being off topic or anything like that. It has to do with protecting any case you have.
If the attorneys for the other party happen to search the internet for any character references on you, they could potentially find this thread. The whole reason you started this thread and the topic of most of your subsequent posts is: "how much money can I expect."
Do you know how that comes off to defense counsel? |

I have been in an accident that totaled my vehicle and was the fault of the other driver. I had no attorney and collected pain and suffering including all medical and other expenses from the persons insurance.
Please post ALL details of everything including any legal details here and I will help you out.

I know for a fact this is true. When I got a concussion a couple years ago I ended up spending like a week on the couch watching nothing but Jersey Shore. Then I sent a long letter to MTV's head of programming thanking him for bringing such quality, enriching and inspiring television to living rooms the world over. |

If he's trying to build a legal footing for saying that the crash really messed up his cognitive reasoning, he's doing a marvelous job. |
