Image theft. How would you respond?

This is his response to me after they removed the photos (Note I messaged him and he failed to answer so I went to facebook with dmca)...........
"Where was that posted ANYWHERE on facebook again? It is not stealing at all unless it is posted on the photo or on the facebook post. You can look anywhere and it is not found. If it is done by a proffesional they always put something stating this. Other then that it is free game if you fail to follow copy right laws. I deal with proffesional photographers all the time, I know copy right laws. If any details were provided i would have contacted you first. Since there were not there was no way to know. If you think you are proffesional then you should have things posted correctly so that this will not happen. It is very unperfessional to have things deleted and turned in when you had not contacted me first. I would be more then willing to give you credit for your work, again if it was provided in the first place.
Looking at the origianl photo again, you can see that all it has as its "Copyright" law is the words Chrstian Concert Photos. If that is your company it is pretty general, it does not state an actual name or contact. Number two again it has nothing that states that this is under copyright laws. Who am I supposed to contact if this is the case for your companies name? Where is the copy right symbol?
Second this is not a company, it is a ministry. This is the genre that we deal with and so I know most of the photographers. Christian and non-Christians who do this as their work. I have never ran into any kind of problems from any of them. You are the first and you have passed lines that was not yours to cross."
UM my company name is ChristianConcertPhotos Duh. I'm just so pissed right now. I bust my ass trying to cover events and everyone thinks they can just take what they want. |

I deal with athletes, hair stylists, politcians and farmers regularly with my job. I suppose I can consider myself an expert on their careers too. Dude is out of his mind. |

Honestly people like this are a dime a dozen and they cant be reasoned with. You own that image the second you take it (at the basic level) and he fails to grasp that. And just because you find a photo without contact info doesn't make it free.
If they pulled the image then let it go and watch their blog or whatever for more infringement and then approach it in a more legal manor. |

| ->> It does have Christian Concert Photos which is the domain name without the .com . We just had a new logo made to include the name with a .com and will use that going forward. All my photos do have all the info embedded in the meta-data plus all my info ( Copyright © 2011, Joseph Zimmerman / http://ChristianConcertPho;tos.com/) is posted in the captions/descriptions which facebook automatically adds to uploaded photos |

->> I'd just hit him with another DMCA if he posts anything more. It's his responsibility to obey copyright, not yours to explain it. Facebook provides enough information about the process for him to educate himself that way.
There's no distinguishing between a "ministry" and a "company", other than some "ministries" having a 501(c)(3) which changes how you handle taxes. He's just being irresponsible and needs to learn a lesson. |

If its unprofessional for you to enforce your rights, then there's no point in responding. Some people are simply not capable of being educated, and you're better off banging your head against a wall rather than trying to move an immovable force. |

->> Joseph, you have no legal burden to provide contact information. The Re-user has 100% of the burden to either determine ownership and obtain permission or not use the image.
However, it's always a good idea to provde as much info as is practical and look as "perfessional" as possible to discourage at least some of the nimrods.
