Unlicensed Usage - 2 Sites

->> I found 2 websites that were using my images and I thought I'd pass it on because they have a lot of professional images running. One is actually selling books too.

This site is fully commercialized with doubleclick ad network and he sells books. I'm having my son purchase his books because his paypal account doesn't include my domain name.
I informed this guy that he was using unlicensed images. He took mine down but all the others are still running. I'm curious if he's including images in his books. I'll add to this post once I receive my books.

This guy ignored my contact with him so I went through Google. Google looked into it and took the single post down. 2 weeks later the guy put the post back up with my image included. I informed Google, again they took the page down. The didn't kill the entire blog despite the fact that I informed them that the guy was using lots of copyright infringing images.

I'm one of the staff photographers for the Indy Indians and it's not in my contract to license the images to a third party, and they are very good about honoring our agreement.
It looks like this guy is using images from all over.

->> I received an email from Tim Williams, the person who runs Pirates Prospects. He runs the website himself but has recently brought on contributors for the content and he pretty much blamed the contributors.
He said they are told to get permission to use the images but we see how that works out. I've made the Indy Indians aware of the site and they will be going through it looking for unauthorized image use.
From today forward, there will be invoices sent for image use and each unauthorized use will be passed on to the legal department.
I'm also curious, he publishes a book and sells it, using pictures of players in the Pirates uniform (and other affiliated teams). He told me in an email that those images are his, because he took them. I wonder if he has a licensing agreement with the Pirates? Just because he took them, doesn't mean he can use them without the proper licensing... |

Actually, he or any one else who wish to write/publish a book on the Pirates or any other team do not need a licensing agreement with the team. Book publishing, like newspaper and magazine publication is considered editorial content. However, if he uses photos or (un)published stories from other sources in his publication, he would need to license or purchase the rights to that content prior to publication.
On the flip side, if he is producing trading cards, posters or using/licensing the images for advertising or marketing purposes, he would then need a license from the team, any recognizable person in addition to the individual players and the company of any trademarked or copyright work/product that appears in the image. |
