I have a feeling Mr. Murphy will end up winning but, after all the legal fees, I doubt he wins at all.

->> One of the advantages to having registered your images with the copyright office is that you can go after legal fees from the infringer as well as punitive damages. If your image is not registered you can still sue the infringer but only for compensation for the usage of the image. Hard to find a lawyer that will take that case.
