Billabong XXL big wave contest and photo release

->> Today I received my nomination and congratulations for capturing "one of the great moments in this amazing year of big wave surfing." My image was one of 5 finalists for the 'biggest wave of the year category'. Prize money = $4,000. Cool right?
It goes on to say that they need a large file to print and judge the possible winning wave and, by the way, could you sign this entry form/photo release...
I read it and...The photo release basically gives Billabong all rights to the photo including transfer of copyright if they decide to pursue it. The agreement uses all CAPS to describe that they...JOINTLY own on a NON-EXCLUSIVE BASIS all the images and that BILLABONG BECOMES THE LEGAL OWNER OF THE PHOTOS/VIDEO if you win...
The event is held every year and is Surfing's version of the academy awards only with a blue carpet and a more raucous crowd. I declined the nomination if I had to sign the waiver and have no regrets. I can never find the right thing to wear to that gig anyway. |

| ->> Would you normally get paid $4,000 or more for this sort of agreement if this were an assignment or commercial contract? If so then good for you. If not then, man, you passed up a bunch of free advertising and might want to rethink that decision. |

The last time I got offered "payment" for surfing images that Hurley wanted, it came in the form of board shorts and "t" shirts. And their marketing guy told me I had a chip on my shoulder when I told him that my bank wouldn't accept board shorts as payment for my car loan!
Thanks Dave for "defending the fort". $4k is no where near enough for eternal rights! |

Nice work for standing up for your rights. That is hideous but all too common these days.
I'm sure you'll make that much money or more off licensing the image to the surfer's sponsors and through other outlets. |
