Photographer Wins Copyright Suit Against Artist

->> Artist Richard Prince used photographer Patrick Cariou's images without permission, added some graphics to them, and then profited handsomely through selling prints and books of the derivatives. The shooter sued and just won. All copies of unsold books and prints must be destroyed including digital files and plates that could be used to create more copies. The monetary damage hearing begins in May.

The defense was fair use which didn't fly with the judge.

If you aren't out there being diligent about searching to see if your stuff had been swiped, you are losing money and letting folks abuse your copyright.

One company said the excact same thing to me when I contacted them wondering why they had used my images for commercial use. It's very disturbing that marketing people in big companies can say something like that..

->> Make that two more last night. These folks think Google Images is a free photo service. So the images we are making for editorial purposes that get used on the internet at websites, they are just Shift-Alt-F4-ing them and using them. Lovely.
