Photos used illegally

->> A local TV station ran a story on an MMA fighter that committed suicide after killing his girlfriend and I guess they were looking for photos of the fighter and found them online. Instead of paying to license an image they just put up a link to my photos on the wire services site which contained several photos of the fighter and his girlfriend who was a ring girl.
Anyway my question is, is this illegal and has it happened to any one else and how did you handle it? I send an email to the wire service and also the tv station. Thanks |

| ->> Probably not illegal if all they did was post a link to your photos. If that's the case they didn't use them they just pointed people to a place that was using them and if the wire service had the right to post them it looks like no harm, no foul. |

| ->> Tom, that's how a wire service works. The television probably pays a fee to use the wire service....hence they linked to it....plus...once you sell the photos to the wire service....well....you pretty much has no rights any longer... |

Hotlinking would require a license - so if they use the image itself (which is coming from the wire service's site), and embed the image on their own page even without copying, they would still need to pay usage rights.
If they're providing a link to the wire service's site (like "click here to see a great photo on the AP wire"), they're in the clear. |

| ->> Chuck, The wire service is Icon so I don't think they pay a fee to use the service and the photos were not sold out right to the wire service. I shot the event for the promoters and was paid to cover the event and in addition I uploaded the photos to Icon. The link that was posted on the news station was a link that went to Icon's gallery and a specific photo. Anyway thanks for the replies everyone. |

| ->> Ok now I have found my photos on other news websites and they have the actual photos and they still have the Icon water mark on them. Should I send them a bill for the photo usage and a penalty included for stealing them or just call them and demand payment? Also how do I take a screen shot before contacting them? I just saved it to my favorites so far. |

| ->> If you have a pc, use the "snipping tool" [start > all programs > accessories > snipping tool] to make an image of your current screen which you can save as a jpeg. Someone else might be able to help you on how to take a screen shot with a mac. |

->> Another way to take a screenshot on Windows is to simply hit the printscreen (PrtScn) button on your keyboard. It is often located at the end of the row of F keys. This will save your entire screen to your copy/paste clipboard. Then open up a new document in Photoshop and hit paste. It should create the document to the exact size of the screenshot.
For Mac, hit Apple+Shift+3 for a full screenshot or Apple+Shift+4 to display crosshairs for you to click and draw your screenshot. I believe either way, the screenshot will save to your desktop as an image file with some generic name like "image001" or something like that. |

As always, it's simpler on Mac.
For a screen shot just hold down the Command + Shift + 3 keys. |

Here is an update: I spoke with the TV station and decided there was no violation but I did explain to them how a wire service works and he agreed they usually just link to facebook and my space not a wire service and said he would get with his web team about linking to wire services etc. since this is how photographers make money and he did not feel they should have linked to the site.
When I talked to the editer at the newpaper he said they photographed their comptuter screen with my photo on it and was under the impression that since they photographed their won computer it was not a violation of copyright. I tried to educate him as well on how photographers make a living and told him I would be sending him an invoice. He offered to take the photo down but I told him it has served its purpose and has been on their website for 4 months so I would send him an invoice. He said he would talk it over with his publisher. |

I've been finding my images that were lifted off of my website and blog site for the past few weeks!
Terez Owens lifted some.
3 other sites had lifted images, not linked but grabbed.
Tonite I found a site called www.in.com that had some images lifted from myself and some current SS shooters as well. (note to ya'll, check your name when you get time)...
It is part of this business, and yes it pisses us off, you have to stay on top of it continually, just google your name once a week and then send off a letter if you can find an address.... |
