However, there are a lot of very strong photo illustrations that have won in the past, this image (assuming there was a flip) included, that do deserve recognition. As was stated by Israel - the shot was set up. It is not a news shot and frankly I don't see how it could be mistaken for one. When I look at it I see "conceptual portrait". In my opinion, the only time there should be a question of ethics is regarding a news shot. Ethics aside, I don't think it's a bad idea to add a photo illustration category for shots such as these.
