Standard Practice?

->> Is it standard practice for a newspaper photographer to post & sell images on her/his personal website from an assignment for the paper she/he works for?
This would be a full time employee, not a freelance shooter hired for a single event. |

->> It depends on the arrangement they have with their employer. If they have no arrangement, then the images belong to their employer.

->> Generally for a full-time employee the images they take would actually be the property of the publication so no, that would not be standard practice.
Its usually frowned upon to be doing that even as a freelance shooter, unless you've specifically been given the right to "double-dip" on an assignment.
Several reasons for this, including first and foremost, if your granted access to an event through a publication to provide editorial images, the sale of said images could be in violation of the credential and result in the publication losing the ability to cover the events.
Additionally, as an assigning editor, you've got to wonder if your photographer is shooting first and foremost for his own sales and not giving 100% towards objective journalism. I've covered many events as an event photographer and plenty as a photo journalist and its usually quite a different approach it how you shoot. |

| ->> It also depends on how the newspaper pays for equipment. I supplied my own gear when I worked at a newspaper so all resells were mine for the taking. This was 10 years ago and I had it in writing from the publisher. |

->> Darren,
If the photographer is a traditional employee of the publication, the publication owns the images. It does not matter whether or not the photographer owns their own gear.

->> I was in the same position as Darren at my old paper. Since I used all my own gear I negotiated the ability to handle reprint sales myself and keep all profits. I also got this in writing from the publisher to make sure I was covered.
As Mark mentioned this wasn't a right, but something I negotiated based on the situation. |

| ->> I have a similar agreement with my publisher at the paper I work for. Mine's unusual in that I also help out at a daily paper with my photos. I do put my photos in galleries on the paper's website. |
