I was looking through the photoshelter contract and was wondering if anyone could help me interpet this. Is this for photos you upload or content you post on the message boards?

Posting. As a Content Provider, you will be entitled to upload, post, distribute or disseminate (collectively, "post") Content (the "Posted Content") on the Site, subject to your Storage Allocation. You hereby grant and agree to grant PhotoShelter a non-exclusive, royalty-free, fully paid up, sublicensable, worldwide right and license to use, reproduce, modify, display, perform, distribute, and create derivative works of the Posted Content in connection with the Site, including the marketing and promotion thereof.

->> Translation: If we like your photo(s) we have the right to use them as sample images to promote and/or advertise PhotoShelter however we want. In the process we might place text over your image or crop it to fit into an ad or promo.

Does this bother me. No. I would actually be excited to have my work used to advertise PhotoShelter. PS has become a front runner in this industry and the exposure would priceless.

I really want to know the answer...it's not my intent to cause controversy, bash or otherwise induce bad feelings. My question is genuine and I sincerely would like to know the answer. Photoshelter is highly endorsed around here so I feel like I might be stirring a bee's nest, but...

How is this any different than all the other "rights grabbing" contracts that are consistently lambasted here? We are shown example after example of what type of contract to avoid. How to avoid signing it, etc. this reads much like the dribble we see in contests, concerts, etc.

Is it okay because you will get some exposure at PS? How is that different than any other rights grab where I might get exposure?
Why is this acceptable and others are not? Or is it?

I hope I don't get my first in appropriates or anything over this, but I'd like to understand it better.

"As part of your use of the Site, you may upload, post, distribute or disseminate (collectively, "post") samples of your work, images, videos, animation, files, data, information and other content and material (the "Posted Content") on the Site. You hereby grant SSC an irrevocable, nonexclusive, transferable royalty-free worldwide right (including any moral rights) and license to use the Posted Content for purposes of promotion within The Site. In connection with the operation and promotion of the Site, you agree that SS has the right to copy, cache, modify, publish, display, distribute, translate, create derivative works from, and store the Posted Content, regardless of the medium, technology, or form in which it is used. For example, SSC may use the Posted Content to promote your material, on your behalf, and may indirectly include the content during the course of Site demonstrations. SSC does not claim the right to use your images in any way other than on the Site itself, and is not responsible for any unauthorized third-party image usage that may occur."

I remember it being questioned years ago and it was explained that it was necessary if Sportsshooter.com featured you on the top of the front page.

I can't find the original post, but someone questioned the wording of the clause and it was modified slightly to address the person's issue.
