MaxPreps & editorial use of their photos

->> Got a call from an online Lacrosse magazine that wanted to use some of the photos in our archive for an upcoming issue.
I asked what they are paying for usage and he commented they had recently paid MaxPreps around $5 for one small digital file that ran inside.
Checking their site, MaxPreps does not appear to break out prices for editorial use. The prices listed on their site seem to apply to everyone regardless of how they are used? Am I missing something here?
Regardless, I'm not licensing photos for editorial use for $5. |

Sportshooter member Todd Shurtleff is director of photography for MaxPreps and handles licensing, he can help you. Maxpreps is owned by CBS Sports and CBS pays more than that for images. Todd would not let them do that to our images. |

| ->> Also, the image prices you see on the Max Preps site are for personal use only, not for editorial use or commercial use. Maxpreps does take action when images are not being licensed for use. I personally know of Max Preps taking action and having a website remove unauthorized images they were illegally using. |

I went into the pricing info on the Maxpreps site and they give the option to download files of various sizes as well as print pricing, but there is no mention on that specific page of personal use vs editorial or commercial use.
This may occur once you commit to download the file, but when you are just looking at the pricing for files and prints, it's not clear.

This Agreement governs personal use of any images purchased from MaxPreps, Inc. under the terms of the non-commercial, royalty-free image license. If you are interested in a commercial license, please use the �Request a Commercial License� link.

->> Phillip, I'm Director of Photography at MaxPreps and can definitely state that we have NEVER licensed an image for editorial use for only $5 and we never would. That person is either lying to you to get a very low quote or they "stole" that image by accepting the digital download agreement for personal use and then published the image without a license agreement.
I would love to know which lacrosse magazine this is so we can go after them IF they really did publish one of our photographers' images without a license agreement. |
