Scout.com using an image
Matthew Sauk, Photographer

->> http://recruiting.scout.com/2/909857.html

They are using an image I took of this player without permission.

I used the contact us but honestly I am not sure that even goes to someone.

Anyone know of a real contact I could email about either paying for web use or taking it down?

Thanks

I would try contacting the recruiting manager who posted the article. I would also check with MaxPreps to see if thats how they got it. Not sure how MP is telling the photogs when a pic is used but I know they are doing invoices for payment for the pics at the end of the month.

I think I know how they got it, the players brother. I sold him those images after the season. Even though I told him they were for personal use only, I think he gave them the images to use.

Another website using my images, you can even click on the bottom one (full image) and view my exif information.

I have contacted that website owner and asked him to take it down or please pay a web usage fee. (same thing I have done with scout.com)

Yeah the giving credit to other people is what kinda irked me. Especially when the exif is still in tact.

Your exif is intact in the scout.com image too - did you provide his brother with the file?

I will probably contact the person who wrote the article tomorrow about it.

Who gave them the image is not relevant. Copyright infringement is like "Hot Potato." The end user is responsible.

What's most important is whether you registered the image.

->> We need to keep fighting the battle against unauthorized usage of photos as well as denying requests for free photos. It's a losing battle but one worth fighting. Contact every website, blog and publication that is using your photos without authorization, and ask them to cease and desist.

But it's not the small sites ripping off photos that bug me as much as the large corporate entities or educational institutions that ask for freebies from us.

I've had numerous professional sports teams and major universities asking me for free photos this year (the request always comes with the standard statement "we'll give you full credit for the photo"). I always ask the requester, usually someone in the team media department, if they are being compensated for their services and whether their team photographer gets paid, and why I don't deserve the same right to be paid for what I do. It gets easier to say "no" to free photos the more times you do it.

->> Juliann is right - I had one writer contact me AFTER he put my image on his article asking permission to use it. I denied permission as there's no way I can justify giving it to them free when they are collecting payments for subscriptions! What did he do? NOTHING! Left the image there and stopped answering emails.

Send them an invoice!

Speaking of stealing images - some guy is using one of my images on Ebay to sell a domain name of a draft pick. Correct me if I'm wrong but he's using my image to sell the domain (commercial) and is also using the players likeness to sell the domain without permission - both illegal, even if it is an Ebay listing. Someone is getting a bill!
