->> This is what brought up this question. This is my shot from NOLA vs Atlanta that moved on the AP wire and got a ton of play. It was picked up by Wall Street Journal as one of the pics of the day and apparently now it is on ebay.........That said it supposedly came through Photofile which I know has an agreement with Getty.

Did they get access to the AP wire ? (If so can I out them on future images I transmit or are they allowed by NFL to sell whatever they like because they are licensed ?)

->> Matthew- The Associated Press started the 2009 NFL season as the exclusive source for photographs for commercially licensed NFL products (they outbid Getty for this right for the next 5 years). Getty has had these rights in the past and still has them for NBA, MLB and other sports.

Since your image ran on the AP wire it probably went into a pool of images that Photofile- an NFL commercial licensee- can choose from to make licensed prints of that they can then sell to the public.

If you were shooting for a paper and this was a member pick up then I would imagine you would have the control to not allow commercial sales if you wish- but I am not sure.

->> Ok Brad that was the info I was looking for, No Harm no Foul. I did not know they had outbid Getty for the contract. I am not as concerned now as I was originally thinking they still only used Getty images and I did not know how my image had ended up there.

->> Matthew, to add to what Brad said, the ebay seller is not Photo File but a wholesale customer of Photo File so at least he is selling stuff that is licensed rather than just stolen.
