$45 Negatives Could be Lost Ansel Adams Photos

A statement which is the first step towards legal action against this guy simply because he was lucky. They deny it, then sue him because he will try to print them and sell them or sell the collection as a whole to a image conglomerate.
Why are people/companies so stupid? Wouldn't it be easier to work with this guy up front to verify the negs either way? I'm sure it would work easier than the path they have started down. |

Stated otherwise, even if the plates have value, I'm curious if the Trust, on the basis of copyright, might seek to enjoin their use for producing prints. |

->> Assuming the negatives represent "never published, never registered works," which seems to be the case based on the article, the relevant copyright term is "life of author + 70 years."
Ansel Adams died in 1984, so if the unpublished and unregistered assumption is correct, the copyright term expires in 2054. |

->> These photos are probably legit. But the AA trust has a lot of balls denying they are genuine AA shots and then suing to keep them from being published. The copyright issue is moot if the AA trust denies they are genuine. They can't have it both ways. However, if they are suing to keep him from publishing them as works of AA then I see their point. But since the handwriting on the envelope was determined to be that of Virginia Adams, then the writing is on the wall (no pun intended). To continue to deny them as genuine is a bit absurd. The AA trust is more than likely not happy to see a large addition to his works not under their control.
I sure would like to know who it was in Fresno that had these shots... Makes me want to get back out on the yard sale circuit again. |
