They would had tossed that contract in the fireplace. Even pay the photographers more.
The problem is that many newspapers photographers didnt have the balls to say NO to AP. They stood like lambs.
All it would had taken was for a bunch of fREElance photographers to stand tall boycotting AP or any wired service or newspaper flaunting their ridiculous contract.
IT worked when a few photographers, including myself, started Editorial Photographer (EP) http://www.editorialphoto.com/ back in 1999... We refused to work for Business Week and then Forbes until we got better contract and better payment. Now any photographers that shoot for any of those magazines is reaping those rewards. That is how as a WHOLE we can make changes. It was nothing personal against any of the great folks working there. But we needed to make a better living and fight for us and those to come after us. Those low fees were not helping us.
The same could had happen with AP if a mass of newspapers photographers had stood their grounds.

->> If the version at the link in Douglas Jones' message above is indeed the current version, it's still awful:
* It limits the use of images ONLY to stories about the game itself. That means no file use in stories about a player.
* It claims the right to use, without payment, any images shot by the credential bearer on the official websites and in the official publications of the SEC and its member schools.
* It limits video use to conventional "television" news reports. This means that newspapers may not post video from the games (of any length) on their websites without the execution of a separate agreement.

I find it reprehensible that the Southeastern Conference is going to somehow claim my intellectual property that i create as their own and to try and take it and give me NADA.
I'm sorry but with all that ESPN & CBS monies, there is no excuse. |

->> Dave...No language on the credential. Usually, the school prints these a good ways before the season starts. I WAS very surprised that there was no sign off sheet or something of that nature.
I'm still not sure if this policy even governs games when the SEC school plays an out of conference opponent. The policy is so vague that it is tough to know.
On a side note, I emailed Mr Bloom, the Media Relations guy for the SEC about the policy. He was very kind to email me back. But, from his response, I still can not tell if I could post anything here, legally that is.... |
