ODE magazine - not paying

->> I was contacted by the creative director of ODE magazine ( based in California), Eric Siry, in December last year to photograph the environmentalist Nick Rosen for them, here in the UK. The rate was low but I was free, so why not? Big mistake.
Though they used the work both in print and online and emailed to say they liked the images – my invoice is still unpaid. Indeed they no longer respond to any of my emails.
In eighteen years I have had some late payers but never a non-payer like these guys – been lucky maybe. Legal action from the UK seems too expensive to attempt given the amount due – so here’s my advice, if contacted, avoid!!!! |

->> There is, but advice has been it doesn't work against US clients - unless anyone knows different!

| ->> Martin, it would appear you have little to no recourse in a matter like this. The British courts have no authority to enforce civil laws in the United States. If you have another opportunity like this in the future, I would ask the client pay before they play. Otherwise, politely decline. |

->> Awareness isn't the issue, they acknowledged the non-payment but have subsequently ignored my email and failed to pay.
Without a viable legal address - unless the option is spending money in excess of the outstanding amount - my only recourse is to warn as many photographers as I can, on both sides of the Atlantic - what sort of an outfit they run.
Hence I am posting this "advice" in as many places as possible. |

Just say something like you are owed money on an outstanding invoice for some time now and all attempts at you collecting have been ignored. Could you please get back to me. Thank You!" |
