Take caution shooting at MSG+ televised events

->> Yesterday MSG+ had the TV rights to shoot a high school game that we had the still rights to. The banner for my company was at the midfield line on the far side of the field directly across from the MSG cameras and about 2000 fans in the stands watching the game.
MSG approached us with about 10 minutes to go before the game started and told us to remove our banner because it was in violation of their contract with the school. Our agreement with the school was that we could put up two banners wherever we wanted and we had used this position in the past at televised and non televised games.
I refused to take it down unless the school said we had to. MSG showed their contract to the school and evidently they can have ANYTHING removed that they don't like that appears on the field. Talk about a broad......
It's an annual event that we've covered for the past 4 years and we've never had a problem with MSG or any other TV venue that covers it. We've also covered other televised events with our banner in a similar position and have never had a problem.
If you shoot televised HS or College events and have an agreement with the school for signage at the event, make sure there is no contractual conflict BEFORE the event start. Ask the school to check the contract, or get you a copy to review.
Frankly, this was a bunch of BS that some field producer at MSG decided to push at this specific venue, but protect yourself and review the contracts for televised events you are shooting. When push comes to shove, the school is going to back TV over stills every time.

->> It does not usually affect us either, but we are seeing this type of thing more frequently at larger HS venues like big annual rivalry games and regional playoffs and state championships.
Last year a photographer from Newsday went upstate to shoot a NY HS state championship game. When he got there he was told he could not shoot it because the still rights were exclusive to maxpreps, even though he was shooting for editorial use and had been given credentials to cover the event. Took him quite some time to get cleared.
So contract conflict issues are popping up everywhere... |

| ->> What I love is TV cameramen who get pushy and arrogant on the baseline at basketball games; they ignore lines, go where they want, make people move, lean way out in my line of fire, etc. But, there's nothing I can do because it's true, the school will always err on the side of TV; in most cases they are paying to be there. |

| ->> I second the small town attitude. They locals here really take care of us in so many ways larger towns and big venues do not. There are a few disadvantages, but for the most part, you don't get lost in the hustle of other media types horning in or getting in your way. Nice. |

Why didn't you remind the school of your contract? The school executed two contracts which are in conflict. They cannot unilaterally change the terms of your contract without your consent - which you don't have to grant, in particular without compensation. |

It was not worth getting into a fight so close to the start of the game. We have a long term relationship with the school. I think they were very surprised at what msg did. It was too late to fight about it at game time, So I told the school I would do whatever they wanted me to do. They reluctantly asked me to take it down, so I did.
This event happens every year, next year we'll go over the TV contract with the school prior to the event.

| ->> Next year PAINT your logo/banner onto the field. That will take of the issue, unless they want to mow it ;) OR have custom eye black tapes made with your logo/name on them. EVERY closeup either print or TV will be a free ad! |

You've seen the political lawn signs right? Not the plastic ones that they are using today, the 'old fashion' ones that you would have to staple to a wooden frame. Have a batch printed that are BLANK except for a 2" border. Across the top and bottom have your company name printed. Distribute a hundred or so to the booster club so that the kids can make their signs without going out and buying poster board. Every kid who makes a sign for the game will be holding a sign for you too.
Make sure that the 'backside' is unusable so that they don't just paint the other side and bypass your message. A big X in marker will do the trick. |
