Instagram turned their terms of service into a rights grab

With this update both Instagram and Facebook will have very similar ToS language regarding reuse of images posted to their sites. Not surprising, since Facebook bought Instagram.
For me, it seems hard to maintain your copyright on images posted to either of those services, given the language in the ToS. For what it's worth I post photos elsewhere, then put links on Facebook. |

So much for licensing, model releases, etc. And what happens when a customer orders a 5x7, scans it, posts it on the website whereupon it is marketed without the photographer's knowledge, permission and payment to?
In my case, I have a clause on all my sales forms and invoices that posting any of the images on social networks is strictly forbidden and doing so is a willful violation of the copyright law. I should probably add DMCA too. |

Sad, because its guys like them, and folks like Charlie Dharapak of AP in DC and others, that made Instagram great for me. |

If you do not caption or tag your photos on Instagram, how can they find them for advertising?
So, if Instagram had a beer company that wanted to use one of your photos, they might search for "beer" in their archive. If you don't have any identifying text or geolocations attached to your photos, how would they find your photo of beer amongst the sea of other photos?
I would still take issue with the way they are taking advantage of us, but it may be one way to stay on Instagram and avoid them finding your photos. |
