Chicago Tribune

->> So it appears the Chicago Tribune pulled an image off NCAA.com of South Dakota State Linebacker T.J. Lally.

So I was curious if anyone on this site works for the Chicago Tribune and could help me out, by having the image pulled.

I have already talked to SDSU's athletic department and they have no knowledge of this image being given to the Tribune. My name is not listed on the photo either.

Before I go and write a letter, I was hoping to make this easy.

Thanks

->> I talked to the photo editor. Since apparently, someone from the university, submitted the photo. As part of my contract, I am supposed to be notified of such exchanges so I don't jump to conclusions. But everything has been settled. Still disappointed that with "submitted" photos there is no credit given to me, the photographer, or the university's athletic department.

Sounds to me Robby is doing his best to stay on top of things and is learning better business practices in the process.
Next time he may not be so quick to ask advice on an open forum which will be a loss to him and all of us.

->> I truly think there are not enough people like Chuck Liddy around anymore to wake people up. You don't have to agree, but you do have to think and defend yourself.

In this case, it all seemed, in the parlance of the courtrooms we have to cover, asked and answered.

Robby asking questions here is perfect and one of the examples of why this site is a great resource. Honest question, some honest answers, and an honest follow up question giving Robby something to think about next time around.

I don't know about everyone else, but I have always been around/been friends with other photographers with whom we can pat each other on the back but also be honest without it affecting our friendship if we don't like the work.

Robby, ask away. If I have something to add to a question, I will. In the meantime, just understand that Liddy is often up past his bedtime.

->> I had a photo recently that was used in a newspaper and on online by a reporter who's story was about a college basketball teams upcoming schedule. The school that the beat writer covers was playing a school I cover on a regular basis and for some reason he wanted to use a arena shot of my school in his story. The reporter did a screen grab for the image.

Thanks to Google, I came across the photo. After inquiring with my client to see if anyone had given the paper my photo (no one had done so), I sent a bill to the photo editor. After 30 days, I sent another bill. Not receiving any acknowledgement, I sent another bill to the photo editor with a "cut & paste" of their copyright notice they had on their site (specifically citing their statement of using content without permission).

Again, not hearing anything, I sent a bill and contacted their Accounts Payable department and mentioned how much cheaper it would be if they paid my bill versus facing a copyright infringement suit. 3 days later I received a check for the amount - a personal check from the reporter.

To me it was about making a point, not the amount.

BTW - similar situation with Topps Trading Cards and the contact is not returning my emails. Does anyone have an Accounts Payable contact? Trust me, their website is useless.

->> Golly Gee!!! I'm so sorry that there are such many sensitive photographers on this site, I'm not and never have been a "sugar coat everything" kind of guy. in these days and times what good does that do to pamper every tom, dick and mary out there who thinks they're a photographer because they spent $15,000 on some camera gear. ....to answer the one question above, I don't think I "jumped" to any conclusion about robby reading the contract. He stated, "Since apparently, someone from the university, submitted the photo. As part of my contract, I am supposed to be notified of such exchanges so I don't jump to conclusions"....so reading that, my first thought was, "well why would you even think you needed to call the Trib?" If I shot something for a university and it was part of the contract that they had the right to distribute the photos to anyone they wished the first person I would call would be the university to see if they had provided the photo. hence it made me wonder, if he read the contract. pretty simple logic. you don't have to be a rocket scientist to come to a conclusion such as that.

ďwell why would you even think you needed to call the Trib?" If I shot something for a university and it was part of the contract that they had the right to distribute the photos to anyone they wished the first person I would call would be the university to see if they had provided the photo.Ē

SS is a great source of information. What makes it so unique is that itís interactive, a great resource tool for beginners and pros. It may or may not have been intended to be this way by its founders but thatís what it is now.

The issue I have is when I am taken aback by the insensitivity of so many of the comments. Itís a distraction. I understand a lot of it is bantering between friends and sometimes itís entertaining. Other times itís uncalled for.

Iím not the first to mention this and I certainly hear about it verbally from a lot of professional photographers who donít visit or join SS because of it.

Thatís my point. All of us have to be careful not to shut the door on the aspiring young photographers who look up to the veterans for advice or the loss of getting input from a pro because of the insensitivity of the sites members.

Enough about this rant; letís move on to something productive.

->> Chuck and I have our differences. I have learned to ignore him for the most part. I don't take the rude comments to heart. I just figure that some where in the midst of all the jokes a pointless comments, there are plenty of good informative comments.

This happens every time I ask a question. A lot of folks see my questions as "amateurish" or as a "I can't believe you are asking that" question. There have been a couple times in the past couple years when I caught myself thinking that when new people would join SS. There are some of you out there who need to realize that I have not been working in the field for 5, 10, or 20+ years, so yes, I am going to ask questions that, to you, may sound dumb. I joined this forum to learn from those of you who have been working in the field for a while.

I assumed the worst when I saw my image on the Tribune's webpage, because of the terms of my contract, so I am not in the wrong there. I don't regret calling the Tribune. I actually learned some useful information about papers that distribute to a crowd larger than Sioux Falls, SD. I haven't had the opportunity to have an internship, a chance to fine-tune my skills with a teacher. So every bit of help I get from SS, contacts, and other papers, I will take it.

So let's end it here. I am not here to cause Chuck to lose his hair over my "stupid" questions. I am not here to start arguments. I am here to learn some valuable information which, despite the direction this thread has gone, I managed to pull out of this conversation.

Thank you Ting, again, for the quick and reasonable response, I really do appreciate it.
