->> WG Sports Photos covered a NCAA Div. II M-Lax semi-final match this last Saturday. We covered it for one of the colleges playing in the match. I found out this morning that one of the photo appeared on the online version of Lacrosse Magazine. Since the only people we shot it for was the college itself, I know the college must have submitted the image. So, I went to the SID, who is a good friend & asked him about it. I got this back from him today:

"As we are asked for photos of certain players by media outlets, we do provide them as we have paid for the service."

I have never heard of paying for a service where you are REQUIRED to submit photos. And BTW, I'm not accusing Lacrosse Mag of any wrong doing. I could be wrong, but I don't think they are the ones requiring photo submission. Maybe some of the guys from Lacrosse Mag can chime in and clarify that.

I told the SID in the following email:

"I really understand your situation with this service. While your regular photog, **** ***** might not care or maybe he wants the extra “publicity”. Almost all pro photogs, including myself, would never allow our photos to used by a national publication without being compensated. As freelance photographers, that is how we make our living. From what I understand, Lacrosse Mag pays fairly high dollars for publications of images. If this service is providing them with images, they are earning dollars for someone else's images and that is not right. In fact that is VERY unethical."


OK, all you lacrosse specialty guys, educate me here and let me know if, what, how and why this is being done. Thanks

Didn't your licensing contract with the school specify use privileges/restrictions? seems that the SID is under the impression they may do as they wish because they "paid" for such use ... many school officials (and other clients in general don't really understand licensing issues and/or limitations ...

My advice would be design a new contract offer for next year where the wording specifically states:

The photos provided to the school by "WG Sports" can only be used for school publications and school designated web sites. Any distribution of these photos to Media outlets and publications can be released under the following guidelines:

->> Folks....you're missing the point. I can handle the college and future usage of our images. No problems there, but what I'm asking about a service requiring submission of images, not if I have a contract with this client and whether or not they should have done this or not.

You appearing to be reading it as the school is paying to be part of the media outlets so they are required to give the images away to them.

I think the school might be saying they paid for your service as photographer to shoot and give them images and they have the right to hand them out to media outlets because they own them. Not that they are required to give anyone photos out, but just hand them out when asked.

Unless I am missing some critical information ... I don't think the SID is referring to a "service" they pay for that "requires" them to contribute images ...

It is my interpretation that they (the school) freely offers images they have on hand for outside editorial use that will promote their school, because they "paid" YOU for the service of capturing the images ... they feel they have the right to do so ... hence my questions about the details of your licensing contract ...

If you have further info to the contrary, I would be interested in a clarification of my mis-interpretation ...

->> Many sports info directors don't understand what they can and can't do with photos even when you spell it out in a contract. Some fulfill media requests and assume that since they paid you to shoot the event, they now have the right to use the photo in any manner they see fit.

You have to "train" them to understand what their usage rights are. The easiest thing, assuming you have a contract for all of their events, is to have them forward all photo media requests to you and then you can charge accordingly.

->> My contract states the usage rights they are granted but I always include "no third party usage granted". I also bring it up in conversation and tell them to direct anyone that wants to use the images, to me and that I will take care of the licensing.

->> ... and here we go again. The details of the contract have to be REAL clear on what can and cannot be done with the images. Contracting party editorial, contracting company commercial, Third party editorial, third party commercial...etc.

->> I did misread his email. For that I apologize for starting the thread. With that being said, the problem is solved and the SID will no longer submit without my consent. If all problems were solved this easily.
