->> There are an awful lot of questions that I would have about this entire incident.
I wasn't there so don't know exactly how it happened but, I when a particular photographer manages to be arrested multiple times I begin to have questions about what, exactly, is going on. Is he/she really there in a news reporting capacity or are they, in fact, deliberately pushing the envelope in an effort to evoke a reaction?
I know that our rights as journalists have been trampled, especially in some of our larger cities. I know that we must see that those rights are protected. I do not believe that photo/video extremists who might be out there to make a point, or become a photo martyr are doing any of us any good.
There is no excuse for the physical assault that this gentleman endured. I do have my own personal doubts as to whether, or not, we are getting the entire story.
As a former police officer, I learned that in most cases, you get both sides of the story, and find that the truth lies somewhere in the middle. |

| ->> Being a journalist I have to comment after reading this there is only one side to the story so far....the only person quoted in the story is the girlfriend of the victim. and mr. miller does have an agenda on his website...I do applaud his efforts but I have problems with only one "witness". If it turns out he was unjustly attacked I hope he sues those jerks for all they have....but before jumping to conclusions or going crazy....maybe it's under investigation and the cops are gathering evidence. I just don't want to rely on one person (who is related to the victim) to call out the torches and pitchfork wielders. apparently there are a lot of witnesses...and most everyone knows I usually never side with the cops.... |

| ->> Mike Ullery, Ashi Fachler, wasn't arrested multiple times. You must be referring to Carlos Miller who appears on the right side of the story. Not sure who he is or what affiliation he has but no where does it state in the story that Fachler was arrested during this or any other incident. |

The photographer who was allegedly attacked is Ashi Fachler, he lives in San Diego.
The author of the article who conducted the interview is Carlos Miller, he lives in Miami.
The website the article is posted on, Pixiq.com, is owned by Sterling Publications, based in New York. It contains postings by many authors: http://www.pixiq.com/contributors |

"A police officer who responded to the scene ordered Fachler to walk a block to the ambulance, even though he had suffered a sprained ankle."
and
"Surveillance cameras inside the restaurant may also have captured the incident, but San Diego police have not made at attempt to retrieve the footage."
The guy is obviously beat up, but this story is very much one sided and hearsay without many actual facts backed up...so, Like chuck said, read it with knowing that there is two sides to every story. Nobody deserves to be beaten, but it's written with an agenda.
This is kind of the problem with bloggers. People take what they write as truth, with many times its just opinion or hearsay.
But, I hope he gets justice for his attackers. |

"Photography is Not a Crime" is the name of the blog that the author, Carlos Miller, writes.

| ->> I contacted a local editor I string for at the San Diego Union Tribune to get some clarification. They ran a story about the incident and he's going to let me know what they ran and know. I'll also contact the SDPD Media Relations who is a good friend to get their take. I'll post back when I hear anything. |

Mike, We've been taught as journalists to talk to both "sides" and let the readers decide who is right. But the fact is that the truth often does not lie "somewhere in the middle." Much of the time one side is full of it and the other side is right.
It's important that we call bullshit where we find it and not simply treat both sides as if they were equally valid. They often are not.
