From the "Terms of Service" section:
"By submitting your Submission to VIMEO, you hereby grant VIMEO and its affiliates, successors and assigns a worldwide, perpetual, non-exclusive, irrevocable, royalty-free, sub-licensable (through multiple tiers) and transferable license (with a right to create derivative works) to use, copy, transmit or otherwise distribute, perform, modify, incorporate into other works, publicly perform and display your Submission or any portion thereof, in or through any medium, whether now known or hereafter created. VIMEO shall be entitled to unrestricted use of any Submission for any purpose whatsoever, commercial or otherwise, without compensation to the submitter."
The thing to keep in mind with these deals is although the guys who own Vimeo now might be cool and not abuse this license, if they go under all bets are off. The buyout firms who pick up the assets will recognize the value of such generous licensing terms and use the assets accordingly. In the case of Vimeo, all that gorgeous hidef content could be sold tomorrow to a stock archive, and there's not a thing anyone could do about it.
The recent abrupt demise of DRR is a reminder that this kind of thing can and does happen, and quickly. So it's very important to read the fine print before you click UPLOAD. |

Looking at some other sites, Viddler and Veoh contain similar language, yet contradict themselves somewhat. They both contain the same clauses:
"You hereby grant to Viddler a non-exclusive, royalty-free..." yaddayaddayadda
as well as
Viddler: "Your videos are your own. Viddler claims no ownership rights to the content you submit to the site. You may modify or delete your own content at any time."
and
Veoh: "You retain all of your rights in your User Material."
I mean, there's legalese and then there's BS. This smells awful. |
