it's about time they stop being soft on these guys and hit them with a real charge.
I know sportshooter has law enforcement people as members, how about we hear some suggestions for the D.A. on a charge for Mr. West.

As long as the paparazzi in this case didn't do anything illegal, Kanye West and his bodyguard should be fully prosecuted. |

Actually a case could be made for ROBBERY "stealing or intent to deprive an owner of his property by means of force or fear". I certainly think that would apply in this case.
He should go to jail and pay a huge civil fine, big enought to make it hurt. |

Photog gets new camera and a monetary settlement, and after a couple of days in the spotlight, charges are dropped and rapper retains his tough guy image....
Watching the video, and then the interview with the videographer, it all seems a bit fake.
But maybe its just me being a cynic... |

->> Mike, I don't think it was staged. Those video guys are professionals, just like most of the people here. The incident happened at 8am and it was online at 1:25pm, that's very doable. I do think the photog will get substantially more than 10k out of Kanye's pocket when this is all said and done.
What I'm wondering is how this spins,
A. Stars get a lesson on the 1st amendment.
or
B. Everyone starts talking about how the paparazzi and photographers are evil and need to stop causing this. |

(http://gmy.news.yahoo.com/v/9695755).. it looks like Kanye grabbed the camera from photographer, then his bodyguard grabbed the camera from Kanye and then the bodyguard slammed the camera to the floor. The only thing Kanye had in his hand was a flash (which he threw to the ground).
Any guesses on what camera (+ lenses combo) that was that apparently cost $10K? |

What I would like to know is what exactly the shooter was hoping to get with Kanye at the airport. A shot of him checking luggage? Handing his ID to the security folks? It's not like Kanye was doing anything even remotely interesting... I mean, who would buy photos of Kanye dressed as the Unabomber? |

Kanye, once a gangster, always a gangster - no matter how much money or what skillset they have that brings you fame and money, you can't buy intelligence, common sense, a sense of responsibility and civility. Both his body guard and him are looking at felony vandalism charges and don't know if there are any federal statutes that may apply because it took place in an airport. I can bet you that section 594(b)(1) of the California Penal Code is listed on his booking sheet. The beyond a reasonable doubt requirement should be a formality after viewing the video.
594. (a) Every person who maliciously commits any of the following acts with respect to any real or personal property not his or her own, in cases other than those specified by state law, is guilty of vandalism:
(1) Defaces with graffiti or other inscribed material.
(2) Damages.
(3) Destroys.
Whenever a person violates this subdivision with respect to real property, vehicles, signs, fixtures, furnishings, or property belonging to any public entity, as defined by Section 811.2 of the Government Code, or the federal government, it shall be a permissive inference that the person neither owned the property nor had the
permission of the owner to deface, damage, or destroy the property.
(b) (1) If the amount of defacement, damage, or destruction is four hundred dollars ($400) or more, vandalism is punishable by imprisonment in the state prison or in a county jail not exceeding one year, or by a fine of not more than ten thousand dollars ($10,000), or if the amount of defacement, damage, or destruction is ten thousand dollars ($10,000) or more, by a fine of not more than fifty thousand dollars ($50,000), or by both that fine and imprisonment. |

| ->> aaron, whether or not they were paparazzi or what you think of that said job is irrelevant to this. here is a question for you. your friend is walking through the airport and hust happens to shoot a photo of a no-talent scum bag like this kanye thug. he walks over and assaults your friend in a public place and smashes his camera into little bits. you think that guy has a right to do that? sorry but just because paparazzi might be considered bottom feeders to many of us just standing in a public place and taking a photo doesn't give ANYONE the right to have their ass kicked and their property destroyed. The one thing I noticed in the video was the fool yelling to get "that camera out of my face" and he was 20 feet away.I hope they put that jackass under the jail. |

Now I'm not trying to take Kanye's side or anything, god knows I'd have pressed charges if that was my gear. This is just a straightforward question to give me some clarification. Doesn't TMZ have a reputation for badgering the celebrities that they follow?
Not saying this happened in this case, the video is far too short, for all we know the photographer could have offered West a mint or he could have said something in attempt to illicit such a response, we just don't know from that video. |

->> According to TMZ, The still camera that was broken, allegedly by the bodyguard, is a Canon 40D - valued at $1429.96. Kanye allegedly broke a flash valued at $100, and the bodyguard, again allegedly, broke a TMZ video camera valued at $7,000.
Therefore $8429.96 in damages for the bodyguard - $100 for Kanye. Difference being between felony charges for the bodyguard (damage over $400) and misdemeanor charges, if any for Kanye. |

During a bank robbery, with a gang of thieves, do they divide up the total amount between the suspects to assign who took more or just charge them all together.
why defend there actions?? for the sake of argument,
Two guys acted in concert to forcibly take someones property from another by force and also destroyed the property. they should be charged equally for what sounds like robbery and another charge of felony vandalism to me.
At least in California I believe if you took part in the criminal act, they can charge you the same as if you actually pulled the trigger, so to speak...
This is not about defending the TMZ guys, this is about a person doing a perfectly legal act filming in a public airport, and being attacked.
next time it will be a tourist with his camcorder that happens to see a celebrity and films him for his vacation video and is attacked.
